By participating in the KOC Oil & Gas Techathon, you agree to the following terms and conditions:

“You” means the Participant.
“KOC” means Kuwait Oil Company.
“AUK” means The American University of Kuwait “RISE” means Center for Research in Informatics, Sciences, and Engineering.
"OSI" means Open Source Initiative.

PARTICIPATION

Participation in the KOC Oil & Gas Techathon is fully voluntary, and participants are not entitled to compensation, nor will they be considered employees, independent contractors, or consultants…etc. Individuals who participate shall engage in the event in their personal capacity (i.e., identifying themselves by their own names). The participation of all employees and contractors shall be done on a voluntary basis outside of the participant’s working hours, and such participants will not receive or be entitled to any compensation for their time.

The Oil and Gas Techathon will start on March 14, 2019 and end on March 16, 2019 prior to the start; you must be registered to participate in the event online at https://techathon.kockw.com .

SUBMISSIONS

All submitted solutions shall directly address one or more of the KOC Oil & Gas Techathon statements (“Challenges”), as described at https://techathon.kockw.com to be eligible for posting on the KOC Oil & Gas Techathon website. Solutions that do not address a Challenge will be posted publicly at KOC’s discretion. By submitting a solution, you grant KOC and RISE permission to display, copy, combine, compile, distribute, and disseminate your solution as needed to support the KOC Oil & Gas Techathon event, in addition, you agree to grant KOC the right to use and adopt your solution (if needed). All solutions will be reviewed prior to posting. Solutions will not be accepted if they include:

• Threatening, slanderous, or obscene language.
• Personal attacks.
• Discriminatory language (including hate speech) based on race, national origin, age, gender, sexual orientation, religion, or disability.
• Any material that would violate the law.
• Material that promotes commercial services or products.
• Proprietary information that you do not have the right to make public.
• Solutions submitted for which you do not hold the copyright or other intellectual property rights.
• Personally Identifiable Information (e.g., social security numbers, home addresses, phone numbers).

INTELLECTUAL PROPERTY RIGHTS IN SOLUTIONS

All posted solutions will be available for others to download or use. You agree that any original content (that is, content that you have created for the KOC Oil & Gas Techathon) is freely available without restriction or is licensed as open source as defined by the Open Source Initiative (OSI): http://www.opensource.org/docs/osd

If you do not specify a specific OSI compliant license, KOC and RISE will distribute your original content.

USE OF THIRD PARTY MATERIALS

If your solution requires the use of non-KOC materials (such as a dataset or code) (your “Solution Materials”), you are responsible for ensuring that your Solution Materials are freely available without restriction or, at a minimum, are also licensed as open source as defined by the Open Source Initiative: http://www.opensource.org/docs/osd . Examples of appropriate licenses can be found at: http://www.opensource.org/licenses . You are solely responsible for all required verification or investigation of the requisite availability of your Solution Materials prior to submitting your solution. Any licenses applicable to your Solution Materials must be identified in the documentation submitted for your solution. KOC will not accept for posting any solutions that do not include appropriate license documentation for your Solution Materials.

WARRANTIES

You represent and warrant that you have sufficient rights to:

1. Authorize the publication and dissemination of your solution to support the KOC Oil & Gas Techathon.
2. Use and authorize others to use your Solution Materials, regardless of whether you or someone else owns those materials (as specified in the "Use of Third Party Materials" section of this Agreement). You are entirely responsible for your solution.

This means that you are responsible if your solution:

1. Is determined by KOC and RISE to be defamatory, abusive, derogatory, offensive, or otherwise inappropriate.
2. Violates any laws, rules or regulations.
3. Infringes, or constitutes a misappropriation of, any intellectual property rights or confidential information of any third party.

KOC, at its sole discretion, reserves the right to remove you as a participant and your solution from the KOC Oil & Gas Techathon website for a violation of the event Challenge rules at any time.

PUBLICITY

Except where prohibited, submission of a solution constitutes your consent for KOC and RISE to use your name, and/or place of residence and country information, and/or photo or likeness, and information about your solution for promotional purposes in connection with the KOC Oil & Gas Techathon through any form of media, worldwide, without further permission, payment, or consideration.

LIABILITY

You assume any and all risks and responsibilities to you associated with your submission of a solution. Therefore, you also waive and release any and all claims or causes of action against KOC, RISE, the Kuwaiti Government, employees, and contractors for any and all injury and damage of any nature whatsoever (whether existing or thereafter arising, whether direct, indirect, or consequential, and whether foreseeable or not), arising from the submission of your solution to KOC Oil & Gas Techathon event.

Dispute solution and applicable Law (Jurisdiction) in case a dispute in respect of this terms and conditions, it is settled amicably through good faith negotiation, if this not possible, this terms and conditions shall be governed and constructed in accordance with Laws of the State of Kuwait and subject to the jurisdiction of the courts in the State of Kuwait.

I agree to the above terms and conditions without any objection based on my full will and choice.
